TERMS OF SERVICE
This is the service agreement between you and MIHIRA. By placing an order on mihirabyremya.com, you agree to these terms. They cover how orders are processed, what happens if something goes wrong, and how we resolve disputes.
OVERVIEW
MIHIRA by Remya ("MIHIRA," "we," "us," "our") is a sole proprietorship registered as Mihira By Remya. MIHIRA operates mihirabyremya.com, an online store selling fashion jewellery to customers in India. These terms govern your use of the website and any purchase you make through it.
By browsing the site, adding items to your cart, or placing an order, you accept these terms in full. If you do not agree, please do not use this site or place an order.
USING THE MIHIRA WEBSITE
You may use this site to browse products and place orders for personal use. The following conduct is prohibited:
- Scraping or automated data extraction from the site.
- Posting false reviews or testimonials.
- Impersonating MIHIRA or misusing our brand name, logo, or imagery.
- Attempting to disrupt the site's functionality or security.
- Using the site for any unlawful purpose.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
We do not guarantee that the site will be available at all times, uninterrupted, or free of errors. From time to time the site may be unavailable due to maintenance, technical issues, or circumstances outside our control.
PLACING AN ORDER
When you place an order, you are making an offer to purchase. Your order is confirmed only when we send you an order confirmation email. Until that point, we reserve the right to decline your order for any reason, including pricing errors, stock unavailability, or payment failure.
All prices are listed in Indian Rupees (INR) and are inclusive of applicable GST. We reserve the right to correct pricing errors and cancel orders affected by those errors, even after an order confirmation email has been sent.
PAYMENT
We accept payment via credit card, debit card, UPI, and net banking through our payment partner. Payment is processed at the time of order placement.
If your payment fails, your order will not be processed. If payment is deducted but the order fails to confirm, the amount will be refunded to your original payment method within 5–7 business days.
We are not responsible for the availability, performance, or security of third-party payment or logistics platforms we use to fulfil your order. Any issues specific to these platforms are subject to their own terms.
SHIPPING AND DELIVERY
We ship to addresses within India only. Delivery timelines are estimates, not guarantees. Metro cities typically receive orders within 2-3 days of dispatch; other locations within 4-6 days.
You are responsible for providing an accurate delivery address. We are not liable for failed or delayed deliveries caused by incorrect address details.
Risk of loss passes to you upon dispatch. For full shipping details, refer to our Shipping & Returns page.
RETURNS AND REFUNDS
We do not accept returns or exchanges for reasons of size, personal preference, or change of mind. All sales are final except in the case of a damaged or defective item received.
Opening (unboxing) video required. To claim a damaged or defective item, you must record a continuous, unedited video of the package being opened for the first time, clearly showing the sealed package prior to opening and the item once unpacked. Claims submitted without this video will not be accepted, as it is our only means of verifying the condition of the item at the point of delivery.
To raise a damage claim, contact us within 48 hours of delivery - either by email at hello@mihirabyremya.com or by calling or messaging us on WhatsApp at [WhatsApp number] - with your order number, a description of the damage, photographs of the item, and the unboxing video.
Approved claims will be resolved by replacement or store credit, at our discretion. Cash refunds are not available.
PRODUCTS
We make every effort to display product colors, materials, and dimensions accurately. However, the appearance of items may vary slightly due to screen settings, lighting in photography, and natural material variations.
Our jewellery is plated and contains semi-precious stones. Plating may fade with wear, and natural stones may display color or texture variations. This is not considered a defect.
Product packaging carries the MRP, net quantity, and manufacturer details required under applicable Legal Metrology rules. Care instructions are provided with each order. MIHIRA is not responsible for damage caused by improper care, storage, or wear.
INTELLECTUAL PROPERTY
All content on mihirabyremya.com - including text, photography, product designs, graphics, logos, and the MIHIRA name - is owned by MIHIRA or its licensors and is protected under Indian copyright and trademark law.
You may not reproduce, distribute, or use any content from this site for commercial purposes without our written permission.
PRIVACY
Your personal information - including your name, contact details, delivery address, and payment information - is collected and used in accordance with our Privacy Policy, available at Privacy Policy. By using this site, you consent to that collection and use.
MARKETING COMMUNICATIONS
Order-related emails (confirmations, shipping updates, return status) are sent regardless of marketing preferences, as they relate to your transaction. Marketing emails are sent only if you have opted in, and you may unsubscribe at any time using the link in any marketing email.
INDEMNIFICATION
You agree to indemnify and hold MIHIRA harmless from any claim, loss, or demand - including reasonable legal fees - arising out of your misuse of this site, your violation of these terms, or your violation of any law or third-party right.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, MIHIRA's liability for any claim arising from your purchase is limited to the amount you paid for the product in question.
We are not liable for indirect, incidental, or consequential damages, including loss of profit, data, or goodwill.
Nothing in these terms limits your rights under the Consumer Protection Act, 2019, or other applicable consumer protection laws in India.
SEVERABILITY
If any provision of these terms is found unlawful or unenforceable, that provision will be severed, and the remaining terms will continue in full force.
GOVERNING LAW AND DISPUTES
These terms are governed by the laws of India. Any dispute arising from your use of this site or your purchase will be subject to the exclusive jurisdiction of the courts in Thiruvananthapuram, Kerala, India.
